Terms of Service

1. Agreement

These Terms are an agreement between you and Robert Cochran, Haarlemmerstraat 162, 1058 JZ Amsterdam, the Netherlands (“we”, “us”), for the OMG Chat Android app and web app at omgvchat.com (the “Service”). By creating an account or using the Service you accept these Terms, our Community Guidelines and our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility

• You must be at least 18 years old and able to enter into a binding contract. Giving a false date of birth is a breach of these Terms.
• You may not use the Service if we have previously banned you, or where using it would be illegal for you.

3. Your account

You can sign in with Google, with email and password, or as a guest. Keep your login secure; you are responsible for activity on your account. Guest accounts may be lost if you sign out or clear app data; link Google or email in the app to keep purchases. You can delete your account at any time in Settings (see the Privacy Policy).

4. How the Service works

• We connect you at random (or using filters, if you have Premium) with another user for a live video call. You can skip to the next person at any time.
• Calls are peer-to-peer: the other user's device can see your IP address, and they may be able to capture what you show. We do not record calls.
• Features include in-call text chat (with optional automatic translation, which may be imperfect), reactions, gifts, filters and stickers, and a friends list with direct calls.
• We do not screen users or monitor calls in real time. We act on reports and may use automated and human review of reports, account data and behaviour signals. You use the Service and meet strangers at your own risk; never share personal details you wouldn't want made public, and never send money to people you meet.

5. Your conduct

You must follow the Community Guidelines. In particular you must not show nudity or sexual content, involve minors in any way, harass, threaten or hate, record or share others without consent, spam, scam, impersonate, or break the law. You are solely responsible for the content you transmit. Use the shield button to report violations or block someone.

6. Moderation, suspension and termination

We may remove access to features, suspend or permanently ban accounts, and void unused gems or Premium obtained through fraud, if we reasonably believe you have broken these Terms or the Guidelines, or to protect users or comply with the law. Where reasonable and lawful we'll tell you the reason; you can contest a decision by emailing memegrinders@gmail.com. Bans for serious violations (such as content involving minors) are without prior notice, and we report illegal content to the authorities. You can stop using the Service and delete your account at any time.

7. Premium, gems and other purchases

• OMG Premium is a subscription that unlocks premium features (such as match filters and an ad-free experience). It costs €9.99 per month (or the local price shown in Google Play) and renews automatically each month until you cancel. You can cancel at any time, without giving a reason: on the web, sign in at omgvchat.com and open Settings → Manage subscription (you can also update your card and download invoices there); on Android, in Google Play → Payments & subscriptions → Subscriptions (or Settings → Manage in Google Play in the app). You can also email memegrinders@gmail.com and we'll cancel it for you; see omgvchat.com/manage-subscription. Cancellation stops future renewals; Premium stays active until the end of the period you already paid for, and is then switched off. Web card payments normally appear on your statement as ABFYK* OMGCHAT.
• Gems are a virtual item bought in packs or earned (for example, a daily reward). You can spend them in the app on gifts and unlocks such as reaction packs. Gems and unlocked items are a limited licence to use in-app content: they have no cash value, cannot be exchanged for money, sold or transferred (gifts you send don't give the recipient spendable gems), and are forfeited when your account is deleted or banned for breaching these Terms.
• Prices are shown before purchase including applicable taxes. On Android, purchases are processed by Google Play under Google's terms; on the web by Stripe. We may change prices for future purchases.
• Right of withdrawal (EU/UK consumers): gems and Premium are digital content and services supplied immediately after purchase. By completing a purchase you request immediate delivery and acknowledge that you lose your 14-day right of withdrawal once delivery has started. This doesn't affect your legal rights if an item is faulty or not delivered: contact us and we'll fix, re-deliver or refund. Google Play refunds are also available under Google Play's refund policy.
• If a purchase is refunded or charged back, we may remove the corresponding gems, items or Premium.

8. Advertising

The free Android app shows ads. See the Privacy Policy for your choices.

9. Our rights

The Service, its software, design and branding belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. Don't copy, reverse engineer (except as permitted by law), scrape, overload, or interfere with the Service, or access it by automated means.

10. Changes and availability

We may change, add or remove features and may update these Terms. If a change materially affects you we'll give reasonable notice in the app before it applies; continuing to use the Service after that means you accept the change. We aim to keep the Service available but don't guarantee uninterrupted or error-free operation. If we ever shut down the Service, we'll give at least 30 days' notice.

11. Liability

We are not responsible for the conduct of other users or for content they transmit. To the extent permitted by law, our total liability to you is limited to the amount you paid us in the 12 months before the claim (or €50 if more). Nothing in these Terms limits liability for death or personal injury caused by negligence, for intent or gross negligence, or any liability that cannot be limited under applicable law, and nothing affects your mandatory rights as a consumer.

12. Law and disputes

These Terms are governed by Dutch law. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country, and you may bring proceedings in the courts of your country of residence or in the Netherlands.
